Chapter 13 Is a Debt Repayment Plan
Under Chapter 13 bankruptcy, you give the court a complete picture of your financial assets and debts. The court then calculates a plan under which you repay your debts according to an up to five-year schedule. Your creditors — including your mortgage company — must accept the court's repayment plan if it meets within federal guidelines. In other words, you will no longer have lawsuits or collection calls hounding you — as long as you stick to the repayment plan, you do not have to worry about foreclosure or repossession. However, a Chapter 13 generally does not alter the actual monthly payment amount owed on any secured debts.
